Workers’ compensation may help grieving wife and baby

The time before the birth of a child is filled with excitement and anticipation for families in California. Unfortunately, what should be a time of celebration for one out-of-state family has turned to grief after a fatal workplace accident took the life of an expectant father. As a result of his death, his family may struggle to fulfill their financial obligations; however, the victim’s wife may be entitled to workers’ compensation insurance benefits to help cope with the fallout of the accident.

The incident happened one day at the end of July at Agri-Technology Company. A witness claims that he and the 23-year-old victim were working to clean a plastic tank that contained molasses. At some point, the pump was no longer working because the level of molasses dipped too low. The witness claimed that the victim put on a mask and other gear before climbing into the tank to alter a valve.

According to the police report, the victim — while still in the tank — stopped responding to the witness. Because of the size of the victim, the co-worker was unable to help the man. The co-worker ran for help, and workers used an electric saw to cut the container. CPR was administered, but the man passed away. An emergency room doctor claims that the victim had molasses in his lungs.

Reports claim that the man’s death came just a week before his wife was due to give birth to their first child. Now, she likely faces financial complications due to her loss. Many of her burdens can be helped by workers’ compensation insurance benefits. As many in California have discovered, an experienced attorney can help victims of workplace accidents — including surviving family members of a fatal accident — seek fair compensation.
