Motorist may leave road worker in need of workers’ compensation

Construction work is often dangerous as are the roadways. This typically means that individuals conducting road work are often at substantial risk of being involved in a serious accident. It was recently reported that an individual working as part of a construction crew was injured by a vehicle in another state. Apparently, the worker was using a flag to help direct traffic through a construction zone. The worker had stopped northbound traffic, which consisted of a motorcyclist at the time, when a 17-year-old driver hit the motorcycle and the worker. The impact caused the worker to be thrown into the side of a parked car.

The motorcyclist suffered fatal injuries as a result of the incident, and the worker was seriously injured. She was taken from the scene by medical air transport to the hospital. The report stated that the driver of the car did not suffer any injuries in the incident, and it did not appear that drugs or alcohol contributed to the crash.

It is likely that the worker injured in this incident will need workers’ compensation.
